The recording used is from Artur Schnabel mid-1930s series of recordings of Beethoven Piano Sonatas. The Adshare MG claim would have been in representation of one of the number of European music labels, probably Naxos, who have released CDs of these recordings since they entered the public domain in the EU in the mid 1980s.
Unfortunately, common law copyright protection for this sound recording has not expired in the US (and won't until at least 2067). Because of this, EMI (the original owner of the copyright in the recording) would be within their rights to claim the exclusive right to distribute the recording in the US. In that regard, their claim is probably a valid one. The USA does not have a comparison of terms (rule of the shorter term), so the recording's status in its country of origin is irrelevant to its treatment under US law.
One of the best ways to avoid Youtube music claims is to add licensed royalty-free music to your video's. You can get a wide selection of quality music on Kevin MacLeod's website (
www.incompetech.com) for free. I have never had any problems using MacLeod's original music. But there are always false positives with the traditional and classical tunes, as is the nature of Youtube's Content ID system.

Thank you for your reply Video-Celler, I was more confident of the Beethoven music I had used earlier in the episode of my show that has been removed, since I am in the UK, I believe I used that during the 1914 Jekyll and Hyde, but I was unable to recognise the music used on The Avenging Conscience, is it the same? If so I'll be willing to undertake any tutorials you know of to remove the soundtrack using only Windows Movie Maker, I have heard of Kevin MacLeod, but I have also hear his music can throw up Content ID issues, but they are easily disputed, sadly the whole Avenging Conscience issue has gone deeper than I ever wanted it to, either way I can't upload the episode again until my account with YouTube is back in good standing, which might take some time.

Hey, CinemaGuide,
You might want to check this out.... freeware program for editing audio/video... highly respected, with a good history, and a whole lot more user friendly than Windows Movie Maker. (can replace audio with 2 clicks), although an audio editor (goldwave) would be helpful, too.
